I hereby agree as follows:
1. I hereby release and forever discharge and hold harmless Remedy Athletix, LLC and each of their parent, affiliated and subsidiary companies including each of their respective owners, employees and volunteers (collectively the “Company”) from any and all liability, suits, claims, and demands of every kind or nature, either in law or in equity, which arise or may hereafter arise from my attendance/participation at/in cheer programs, dance programs and/or gymnastic/tumbling instruction offered by the Company (hereinafter collectively the “Activity”). I understand and acknowledge that this Release discharges the Company from any liability or claim that I may have against them including, but not limited to, bodily injury, personal injury, violation of privacy rights, illness, death, or property damage that may result from my attendance/participation at/in the Activity. I further release and forever discharge the Company from any claim whatsoever which may arise as a result of any first-aid treatment or other medical services I may receive due to an emergency which arises out of my attendance/participation at/in the Activity.
2. Insurance: I further understand that the Company does not assume any responsibility for or have an obligation to provide me with financial or other assistance, including, but not limited to, medical, health, or disability benefits or insurance of any kind in the event of any injury, illness, death, or damage to my property that occurs while I participate in the Activity.
3. Photographic Release: I also grant and convey to the Company all right, title, and interests in any and all photographs, images, video, or audio recordings of me or my likeness or voice made by Company in connection with my participation in the Activity.
4. The Company takes reasonable precautions for the safety of all that attend and participate in the activity. I agree and understand that the Company cannot guarantee that it will safely accommodate issues that are specific to me.
5. I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of California and that this release shall be governed by and interpreted in accordance with the laws of the State of California. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.
I hereby express my understanding of the above terms and my intent to enter into this Waiver and Release of Liability willingly and voluntarily by signing below.
